नेपाल–भारत उद्योग वाणिज्य संघ (निक्की) द्वारा स्वदेशी तथा वैदेशिक लगानी विस्तारका लागि नीतिगत सुधारको आग्रह

काठमाडौं — नेपालमा औद्योगिक विकास, रोजगारी सृजना र सरकारी राजस्व वृद्धिका लागि स्वदेशी तथा वैदेशिक लगानीको भूमिका अत्यन्त महत्वपूर्ण रहेको उल्लेख गर्दै, नेपालमा लामो समयदेखि सञ्चालनमा रहेका वैदेशिक लगानीसम्बद्ध उद्योगहरूले विद्यमान नीतिगत तथा प्रक्रियागत अवरोधहरू समाधान गर्न नेपाल–भारत उद्योग वाणिज्य संघ (निक्की)ले सरकारसमक्ष सुधारको माग गरेको छ ।

संघको भनाइ अनुसार १९९० को दशकपछि नेपाल–भारत वाणिज्य सन्धी लगायतका कारणले नेपालमा वैदेशिक लगानीको प्रारम्भिक विस्तार भए पनि पछिल्ला तीन दशकमा अपेक्षाकृत ठूलो नयाँ बिदेशी लगानी आकर्षित हुन सकेको छैन । तथ्यांक अनुसार हालसम्म नेपालमा भित्रिएको कुल वैदेशिक लगानीमध्ये करिब एक तिहाइ हिस्सा भारतबाट आएको भए तापनि, छिमेकी देशसँगको भौगोलिक, सांस्कृतिक र भाषिक सामीप्य हुँदाहुँदै पनि नयाँ बहुराष्ट्रिय लगानीको आगमन सीमित रहँदै आएको छ ।

यसै सन्दर्भमा, नेपालमा विगत तीन दशकदेखि क्रियाशील वैदेशिक लगानीका उद्योगहरूले अनुभव गरेका व्यवहारिक कठिनाइ र समाधानका प्रस्तावहरू सार्वजनिक गर्दै सम्बन्धित मन्त्रालय तथा निकायहरूसँग समन्वय गरी सुधार गर्न निक्कीले उद्योग, वाणिज्य तथा आपूर्ती मन्त्रालयलाई आग्रह गरेको छ ।

निक्कीका अध्यक्ष सुनिल केसीद्धारा उद्योग वाणिज्य तथा आपूर्ति मन्त्री अनिल कुमार सिन्हालाई बुझाइएको उक्त पत्रममा विशेषतः ट्रेडमार्क तथा बौद्धिक सम्पत्ति संरक्षण सुदृढीकरण, ट्रेडमार्क रोयल्टी र प्राविधिक सेवा शुल्कलाई कर प्रयोजनमा खर्च कटौतीयोग्य बनाउने, विदेशमा रकम भुक्तानी प्रक्रिया सरल र समयबद्ध बनाउने लगायतका ११ वटा प्रमुख नीतिगत सुधारका प्रस्तावहरू पनि सुझाइएको छ ।

ट्रेडमार्क तथा बौद्धिक सम्पत्ति संरक्षण प्रबद्र्धनः नेपाल विश्वव्यापी बौद्धिक सम्पत्ति सम्बन्धी विभिन्न अन्तर्राष्ट्रिय सन्धीहरूको पक्षकार भए तापनि, तिनसँग मेल खाने आधुनिक ऐन तथा नियमको अभावका कारण बहुराष्ट्रिय ब्राण्डहरूको पर्याप्त संरक्षण हुन नसकेको निक्कीको भनाइ छ । यसले लगानीको वातावरणमा अन्योल सिर्जना गरेको छ । ट्रेडमार्क दर्ता प्रक्रियालाई लचिलो बनाउने, नक्कली तथा जाली वस्तुविरुद्ध कडा कानुनी व्यवस्था गर्ने र मुद्दा छिटो टुंग्याउने संयन्त्र विकास गर्नुपर्ने माग गरिएको छ ।

ट्रेडमार्क रोयल्टी र प्राविधिक सेवा शुल्कलाई कर प्रयोजनमा खर्च कटौतीयोग्य बनाउनेः विदेशी लगानी तथा प्रविधि हस्तान्तरण ऐनअनुसार स्वीकृत सम्झौता बमोजिम भुक्तानी गरिएको रोयल्टी तथा प्राविधिक सेवा शुल्कलाई कर प्रयोजनमा खर्चका रूपमा अस्वीकार गरिँदा बहुराष्ट्रिय कम्पनीहरू प्रभावित भएका छन् । उद्योगीहरूले ऐन, निर्देशन र अन्तराष्ट्रिय कर सम्झौताबीच स्पष्टता आवश्यक रहेको निक्कीले बताएको छ ।

विदेशमा रकम भुक्तानी प्रक्रिया सरल र समयबद्ध बनाउनेः सेवा आयात तथा प्राविधिक सेवाबापत विदेशी मुद्रामा भुक्तानी गर्दा धेरै निकायबाट लिनु पर्ने स्वीकृतिका कारण ढिलाइ हुने समस्या औंल्याउँदै, नेपाल राष्ट्र बैंकमार्फत जोखिममा आधारित अडिट प्रणाली अपनाई निश्चित सीमासम्म सिधै बैंकिङ च्यानलबाट भुक्तानी गर्न पाउने व्यवस्था गर्न पनि निक्कीले सुझाव दिएको छ ।

एकल बिन्दु सेवा केन्द्रलाई व्यवहारिक रूपमा प्रभावकारी बनाउनेः एकल बिन्दु सेवा केन्द्रको अवधारणा भए पनि उद्योगीहरूलाई विभिन्न निकाय धाउनुपर्ने बाध्यता यथावत् रहेको भन्दै, प्रक्रियालाई साँच्चिकै ‘एकल’ बनाउने माग गरिएको छ।

आयातित सामानको मूल्य स्वघोषणा दोहोरो प्रक्रियाको अन्त्यः भन्सार प्रज्ञापनपत्रमार्फत मूल्य र विवरण पहिल्यै प्रमाणित भइसकेको अवस्थामा विदेशी मुद्रा भुक्तानीका लागि पुनः छुट्टै स्वघोषणा मागिनु अनावश्यक दोहोरो प्रक्रिया भएको निक्कीले जनाएको छ ।

तेस्रो देशबाट भारतमार्फत अत्यावश्यक वस्तु आयातको व्यवस्था पुनरावलोकनः विश्वव्यापी आपूर्ति सञ्जालको वर्तमान सन्दर्भमा, नेपाल–भारत वाणिज्य सन्धीका केही प्रावधान आजको यथार्थसँग मेल नखाने भएकाले अत्यावश्यक कच्चा पदार्थ, औषधि, मेसिनरी पाट्र्स लगायत वस्तुहरू भारतस्थित क्षेत्रीय भण्डारण केन्द्रबाट आयात गर्न अनुमति दिन आग्रह पनि निक्कीले गरेको छ ।

बहुराष्ट्रिय उत्पादनमूलक कम्पनीलाई सीमित दायरामा आफ्नै समूहका उत्पादन आयातको अनुमतिः नेपालमा उत्पादन नहुने तर बजारका लागि आवश्यक वस्तुहरू सीमित परिमाणमा आयात गर्न पाउने व्यवस्था भएमा प्रविधि हस्तान्तरण, बजार विकास र भविष्यमा स्वदेशमै उत्पादन विस्तारको सम्भावना बढ्ने पनि उद्योगीहरूको तर्क छ ।

कच्चा पदार्थ आयातमा अकस्मात् प्रतिबन्धले सिर्जित समस्या समाधानः मट्ठा (प्रोटिन) पाउडर जस्ता नेपालमा उत्पादन नहुने कच्चा पदार्थको आयातमा लगाइएको प्रतिबन्धका कारण खाद्य उद्योगहरू गम्भीर रूपमा प्रभावित भएको उल्लेख गर्दै, आवश्यक अनुसन्धान र वैकल्पिक व्यवस्था बिना प्रतिबन्ध नलगाउन अनुरोध गरिएको छ ।

निर्यात प्रोत्साहन अनुदानको समयमै र पूर्ण कार्यान्वयनः सरकारद्धारा घोषित निर्यात प्रोत्साहन अनुदान वितरणमा ढिलाइ, आंशिक स्वीकृति र प्रक्रियागत अस्पष्टताले निर्यातमुखी उद्योगहरू निरुत्साहित भएको भन्दै स्पष्ट समयरेखा र निरन्तरताको माग पनि निक्कीले गरेको छ ।

ड्युटी ड्रब्याक फिर्ता प्रक्रिया अविलम्ब सुरु गर्नुपर्नेः भन्सार महसुल फिर्ताका दर प्रकाशित नहुँदा वर्षौंदेखि रोकिएको ड्युटी ड्र ब्याकले उद्योगको चालू पूँजीमा गम्भीर असर परेको भन्दै तत्काल दर सार्वजनिक गरी फिर्ता प्रक्रिया अघि बढाउन आग्रह गरिएको छ ।

ब्यबसायिक सामाजिक उत्तरदायित्व खर्चलाई कर प्रयोजनमा स्वीकार गर्नेः औद्योगिक व्यवसाय ऐन, २०७६ अनुसार अनिवार्य गरिएको ब्यबसायिक सामाजिक उत्तरदायित्व खर्चलाई आयकर प्रयोजनका लागि पनि खर्चका रूपमा मान्यता दिनुपर्ने उद्योगीहरूको माग छ ।

निक्कीले यी सुधारहरू कार्यान्वयन भएमा नेपालमा लगानीमैत्री वातावरणमा सुधार भई नयाँ वैदेशिक लगानी आकर्षित हुने, रोजगारी बढ्ने, उपभोक्ताले गुणस्तरीय वस्तु पाउने र दीर्घकालीन रूपमा राजस्वमा सकारात्मक योगदान पुग्ने विश्वास व्यक्त गरेको छ ।

स्वदेशी तथा वैदेशिक लगानी प्रवद्र्धनका लागि यी सुझावहरूलाई यथाशीघ्र सम्बोधन गर्न पनि निक्कीका अध्यक्ष केसीले सरकारसँग आग्रह गरे ।

Nepal-India Chamber of Commerce & Industry (NICCI) calls for policy reforms to expand domestic and foreign investment

Kathmandu – Highlighting the critical role of domestic and foreign investment in Nepal’s industrial development, job creation, and growth of government revenue, the Nepal-India Chamber of Commerce & Industry (NICCI) has urged the government to address existing policy and procedural bottlenecks faced by foreign investment-linked industries that have been operating in the country for a long time.

According to NICCI, although foreign investment began to expand in Nepal after the 1990s – particularly following the Nepal-India Trade Treaty – Nepal has not been able to attract significant new large-scale investment over the past decades. While data show that nearly one-third of the total foreign investment inflow into Nepal has come from India, the inflow of new multinational investment remains limited despite close geographical proximity and strong cultural and linguistic ties between the two countries.

In this context, NICCI has formally requested the Ministry of Industry, Commerce and Supplies to initiate coordinated reforms by working with relevant ministries and agencies, on practical challenges faced by foreign investors operating in Nepal over the past three decades. NICCI has also prescribe solutions also to address those issues.

In a letter submitted by NICCI President Sunil KC to Industry Minister Anil Kumar Sinha, the Chamber has outlined 11 key policy reform proposals. These include strengthening trademark and intellectual property protection, allowing trademark royalties and technical service fees to be treated as tax-deductible expenses, and simplifying and time-bound processing of foreign currency payments, among others.

Strengthening Trademark and Intellectual Property Protection: NICCI notes that although Nepal is a signatory to several international intellectual property treaties, the absence of timely laws and regulations aligned with these commitments has resulted in inadequate protection for multinational brands. This has created uncertainty in the investment climate. NICCI has called for more flexible trademark registration procedures, stricter legal action against counterfeit and fake goods, and faster dispute resolution mechanisms.

Making Trademark Royalties and Technical Service Fees Tax-Deductible:
Multinational companies have been adversely affected by the non-acceptance of royalty and technical service fee payments – made under agreements approved in accordance with the Foreign Investment and Technology Transfer Act – as deductible expenses for tax purposes. NICCI has emphasized the need for clarity and consistency among laws, directives, and international tax treaties.

Simplifying and Streamlining Foreign Currency Payments: NICCI has pointed out delays caused by the requirement to obtain approvals from multiple authorities when making foreign currency payments for service imports and technical services. It has suggested adopting a risk-based audit system through Nepal Rastra Bank, allowing direct payments through banking channels up to a specified threshold.

Making the One-Stop Service Center Practically Effective: Despite the concept of a One-Stop Service Center, industries are still required to approach multiple agencies. NICCI has urged that procedures be streamlined so that the system truly functions as a single-window mechanism.

Eliminating Duplication in Import Value Self-Declarations: NICCI has stated that requiring separate value self-declarations for foreign currency payments, even after values and details have already been verified through customs declarations, constitutes an unnecessary duplication of procedures.

Reviewing Provisions on Importing Essential Goods via India from Third Countries: Given current global supply chain practices, NICCI has argued that certain provisions of the Nepal-India Trade Treaty are no longer aligned with present realities. It has requested permission to import essential raw materials, medicines, machinery parts, and similar goods from regional warehouses located in India.

Allowing Limited Import of Group’s Products by Multinational Manufacturing Companies: NICCI has suggested that allowing multinational manufacturing companies to import, in limited quantities, products from their own group that are not produced in Nepal would facilitate technology transfer, market development, and the potential for future local production.

Addressing Problems Caused by Sudden Bans on Raw Material Imports:
NICCI has highlighted that abrupt bans on the import of raw materials not produced in Nepal – such as whey powder (protein powder) used in biscuits and bakery products – have severely affected food industries. It has urged the government to avoid such restrictions without proper study and alternative arrangements.

Timely and Full Implementation of Export Incentives: Delays, partial approvals, and procedural ambiguities in the distribution of government-announced export incentive schemes have discouraged export-oriented industries. NICCI has called for clear timelines, continuity, and transparency in implementation.

Immediate Resumption of Duty Drawback Refunds: NICCI has noted that the duty drawback refund process has been stalled for years due to the non-publication of applicable refund rates, putting serious pressure on industries’ working capital. It has urged the immediate publication of rates and resumption of refunds.

Recognition of Corporate Social Responsibility (CSR) Expenses for Tax Purposes: Industries have demanded that mandatory CSR expenditures, as required under the Industrial Enterprises Act, 2016, be recognized as allowable expenses for income tax purposes.

NICCI has expressed confidence that bringing these reforms would strengthen Nepal’s investment-friendly environment, attract new foreign investment, create employment opportunities, ensure better-quality products for consumers, and contribute positively to government revenue in the long term.

NICCI President KC has urged the government to address these recommendations at the earliest in order to promote domestic and foreign investment in the country.
